Terms of Service

1. Acceptance of Terms

By accessing or using the Garagat platform, website, and mobile applications (collectively, the "Services") operated by Garagat Technology LLC ("Garagat", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Garagat, governed by the laws of the United Arab Emirates.

2. Description of Services

Garagat operates a marketplace platform that connects vehicle owners ("Customers") with automotive service providers ("Garage Partners"). Our Services include:

• A platform for discovering and comparing automotive service providers
• Online booking and scheduling of automotive services
• Secure payment processing for services rendered
• Customer review and rating systems
• Communication tools between Customers and Garage Partners

Important: Garagat is a marketplace facilitator. We do not directly provide automotive repair or maintenance services. The services are performed by independent Garage Partners. We are not responsible for the quality, safety, or legality of services provided by Garage Partners.

3. Account Registration

To use certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised use of your account

You must be at least 18 years of age to create an account and use our Services.

4. For Customers

As a Customer using Garagat, you agree to:

• Provide accurate vehicle information when booking services
• Arrive at or deliver your vehicle at the scheduled appointment time
• Make timely payment for services rendered through the platform
• Provide honest and fair reviews of services received
• Communicate respectfully with Garage Partners and Garagat staff

5. For Garage Partners

As a Garage Partner on Garagat, you agree to:

• Maintain a valid UAE trade licence and all required permits
• Provide accurate and up-to-date information about your services and pricing
• Deliver services as described and agreed upon with the Customer
• Maintain professional standards and qualified technicians
• Comply with all applicable UAE laws and regulations governing automotive services
• Respond to customer inquiries and complaints in a timely manner

6. Bookings & Cancellations

Booking confirmations are subject to availability and acceptance by the Garage Partner. Either party may cancel a booking subject to our Refund & Cancellation Policy.

Garagat reserves the right to cancel bookings if we suspect fraudulent activity, policy violations, or other circumstances that may compromise the safety or integrity of the transaction.

7. Payments & Fees

• All prices displayed on the platform are in United Arab Emirates Dirhams (AED) and include applicable VAT unless otherwise stated.
• Payment is processed securely through our third-party payment gateway partners.
• Garagat may charge a service fee or commission on transactions, which will be disclosed at the time of booking.
• You authorise Garagat to charge the payment method provided for all services booked through the platform.
• Pricing displayed is the total price for the agreed scope of service. Any additional work requires Customer approval and a revised quote.

8. Reviews & Ratings

Customers may leave reviews and ratings for services received. Reviews must be:

• Honest, accurate, and based on genuine experience
• Free from abusive, discriminatory, or defamatory language
• Not incentivised or manipulated in any way

Garagat reserves the right to remove reviews that violate these standards or our content guidelines.

9. Intellectual Property

All content, trademarks, logos, and intellectual property on the Garagat platform are owned by or licensed to Garagat Technology LLC. You may not copy, modify, distribute, or use any of our intellectual property without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by UAE law:

• Garagat provides the platform "as is" and makes no warranties regarding the quality of services provided by Garage Partners.
• Garagat is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
• Our total liability for any claim related to the Services shall not exceed the amount paid by you for the specific transaction in question.
• Garagat is not responsible for any damage to your vehicle caused by a Garage Partner. Disputes regarding service quality should be raised directly with the Garage Partner or through our dispute resolution process.

11. Dispute Resolution

In the event of a dispute between a Customer and a Garage Partner:

1. We encourage both parties to resolve the matter directly through our in-platform communication tools.
2. If a resolution cannot be reached, either party may escalate the dispute to Garagat's support team for mediation.
3. Garagat's mediation decisions are recommendations and not legally binding.
4. For unresolved disputes, the matter shall be subject to the jurisdiction of the courts of Dubai, UAE.

12. Prohibited Activities

You agree not to:

• Use the platform for any unlawful purpose
• Impersonate any person or entity
• Interfere with the operation of the platform
• Attempt to circumvent the payment system or complete transactions outside the platform
• Collect user information without consent
• Upload malicious code or content
• Use automated systems to access the platform without permission

13. Termination

Garagat may suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion, with or without notice. Upon termination, your right to use the Services ceases immediately. Any outstanding payment obligations survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where appropriate, by email. Your continued use of the Services after the effective date of any changes constitutes acceptance of the updated Terms.
